1. Agreement to Terms

By accessing or using MoGoFun ("we," "our," or "us") at https://mogofun.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the service.

2. Description of Service

MoGoFun is an AI-powered voice generation platform that provides tools such as text-to-speech (including TikTok-style voices), AI song covers, voice conversion, sound effects, and related audio features. Features, availability, and usage limits may change over time.

Some features require an account and may require a paid subscription or credits. We may update, suspend, or discontinue parts of the service as reasonably needed for maintenance, security, or product improvement.

3. Accounts and Google Sign-In

You may create and access an MoGoFun account using Google Sign-In. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under your account.

You must provide accurate information and promptly update it as needed. We may suspend or terminate accounts that we reasonably believe violate these Terms, applicable law, or the rights of others.

4. Acceptable Use

You agree not to use MoGoFun to:

• Violate any applicable law, regulation, or third-party right
• Infringe copyrights, trademarks, publicity rights, or other intellectual property rights
• Create or distribute content intended to deceive, defraud, defame, harass, or cause harm
• Impersonate another person or entity in a misleading or unlawful manner
• Upload malware, attempt unauthorized access, or interfere with the service or its infrastructure
• Abuse, overuse, or circumvent usage limits, quotas, billing, or security controls
• Resell, sublicense, or commercially redistribute the service itself without our prior written consent

You are solely responsible for the content you upload, generate, download, and share, and for ensuring that your use of MoGoFun is lawful in your jurisdiction.

5. User Content and Generated Output

You retain ownership of content you upload to MoGoFun, to the extent you have lawful rights in that content. Subject to applicable law and any third-party rights, you may use outputs you generate with MoGoFun for your own personal or commercial projects.

AI-generated voices and audio may resemble existing people, characters, or works. You are responsible for obtaining any licenses, permissions, or clearances that may be required for your intended use. Nothing in these Terms grants you rights in third-party intellectual property, celebrity likenesses, trademarks, or copyrighted materials.

By uploading content, you grant MoGoFun a limited, non-exclusive license to host, process, transmit, and display that content solely as needed to operate and improve the service you requested.

6. Purchases, Subscriptions, and Refunds

Paid plans, credits, and other purchases are billed through our payment provider. Pricing, features, and usage limits are described at the time of purchase and may be updated prospectively.

Refund eligibility is governed by our Refund Policy. In the event of any conflict between these Terms and the Refund Policy regarding refunds, the Refund Policy controls.

7. Privacy

Our collection and use of personal information, including Google Sign-In data, is described in our Privacy Policy. By using MoGoFun, you acknowledge that policy.

8. Intellectual Property

MoGoFun, including its website, branding, software, design, and documentation, is owned by us or our licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

Copyright and trademark complaints are handled under our DMCA & Copyright Policy.

9. Termination

You may stop using MoGoFun at any time and may request account closure through account Settings or by contacting support. We may suspend or terminate access if you violate these Terms, create legal risk, abuse the service, or if we discontinue the service. Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

10. Disclaimers

MoGoFun is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that generated output will meet your subjective quality expectations or legal clearance needs.

11. Limitation of Liability

To the maximum extent permitted by law, MoGoFun and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the service. Our aggregate liability for claims relating to the service will not exceed the amounts you paid to MoGoFun for the service in the twelve (12) months preceding the claim.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict-of-law principles, except where mandatory local consumer laws provide otherwise.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will post the updated Terms on this page and revise the "Last updated" date above. Material changes may also be communicated by email or an in-product notice. Continued use of MoGoFun after changes become effective constitutes acceptance of the updated Terms.
